On August 24, 2022, the Court held an informal telephonic discovery conference to discuss discovery issues in the related cases of April Polk v. Campbell County Health et. al. Case No. 19-CV-148-SWS, and Maria Redfield v. Campbell County Health et. al. Case No. 19-CV-89-ABJ. After hearing from the parities, the Court sustains Defendants' objection to Plaintiff's Request for Production seeking the applicant file for each candidate that applied for the 2012 position that was ultimately awarded to Dr. Swift. The Court finds the request is not relevant to the underlying claims and defenses of this action. Any claims of negligent hiring/credentialing/privileging are based on Dr. Swift, not any other potential applicants. Further, Dr. Swift was not employed by Defendant Campbell County Health at the time he treated Plaintiff Maria Redfield. The Court next addressed Plaintiff's Interrogatory No. 1 seeking information regarding Defendants' affirmative defenses. The Court finds the Interrogatory amounts to an appropriate contention interrogatory. "[I]nterrogatories that inquire as to legal contentions may be appropriate because they are answered by a party and/or its representatives with the assistance of legal counsel." Funk v. Pinnacle Health Facilities XXXII, LP, No. 17-1099-JTM-KGG, 2019 WL 858718 (D. Kan. Feb. 22, 2019). However, as currently constructed Plaintiff's Interrogatory is overbroad. Therefore, Plaintiff may revise and reissue the Interrogatory. Within thirty days of service of the revised request, Defendants shall produce responsive documents organized in a reasonably usable form as required under Rule 34 of the Federal Rules of Civil Procedure.
