The parties have leave to file separate pleadings for any issue upon which the parties cannot agree. The Motion to Dismiss filed by Third-Party Defendant San Diego Gas & Electric Company (ECF No. 142 ) and the Motion to Dismiss filed by Third-Party Defendant County of San Diego (ECF No. 143 ) are DENIED without prejudice and with leave to refile within 30 days after the Court's order resolving the cross-motions for summary judgment.
