ORDER: The Motion to Dismiss (Doc. 4 ) is granted in part and denied in part. Plaintiffs' Second Claim is dismissed without prejudice insofar as Plaintiffs seek an injunction prohibiting dual tracking in violation of California Civil Code secti on 2923.6. Plaintiffs' prayer for damages is dismissed without prejudice. No later than thirty (30) days from the date this Order is filed, Plaintiffs may file a motion for leave to amend the Complaint, accompanied by a proposed first amended complaint.
