The Court dismisses with prejudice this action sua sponte under 28 U.S.C. § 1915(e)(2)(B) for lack of federal subject matter juri sdiction pursuant to Federal Rule of Civil Procedure 12(h)(3). In light of the Court's finding that it lacks subject matter jurisdiction, the Court denies as moot Plaintiff's ex parte motion for a temporary restraining order 1 and request for issuance of writ of execution 5 .
