ORDER Granting in Part and Denying in Part 44 Motion to Dismiss. It is ordered that the Court grants Individual defendants' MTD as to FootBalance's claim of direct infringement against the Individual Defendants under an alter ego the ory of liability. While the Court entertains doubts that FootBalance will be able to cure its pleading deficiencies, the Court dismisses without prejudice FootBalance's claims for direct infringement against Louko and Kaakkola under an alter ego theory of liability. Additionally, the Court denies the MTD with respect to FootBalance's claim for direct infringement against the individual defendants prior to the incorporation of ZGI. FootBalance may file an amended complaint within fourteen (14) days of the date this Order is electronically docketed. Failure to file an amended complaint in this time may result in dismissal with prejudice of FootBalance's alter ego direct infringement claims as to the individual defendants.
