Filing 25 ORDER granting 18 Plaintiff's Motion to Set Aside Court's Order Dismissing Case with Prejudice and Permitting Leave to File First Amended Complaint. After a careful weighing of the Pioneer factors, the Court finds that Greystone's n eglect was excusable within the meaning of Rule 60(b)(1). While Greystone's reason for failing to timely file an amended complaint is weak, the other three factors favor granting Rule 60(b) relief. In other words, this is an inappropriate case f or the drastic step that is judgment by default. The Court therefore GRANTS Greystone's motion. (Doc. No. 18.) Greystone is ORDERED to file its proffered first amended complaint, (id. at 515), no later than seven days from this order's issuance.
