The parties' 48 Joint Motion for Determination is granted based on the determinations made in this order. Jud gment shall enter in favor of the defendants, Janet Napolitano, Alejandro Mayorkas, and Robert M. Cowan, and against the plaintiff, Edgar Niebla Martinez.
