July 3, 2013 Opinion or Order Filing 35 ORDER. For the reasons stated in the accompanying Memorandum Opinion, the #29 District Defendants' Motion to Dismiss and the District's Motion for Summary Judgment as to Plaintiff's Non-Federal Claims is GRANTED IN PART and DENIED WITHOUT PREJUDICE IN PART. Specifically, the Court shall grant the motion insofar as it requests dismissal of Count IV of the Complaint (Plaintiff's claim under 42 U.S.C. 1983) for failure to state a claim upon which relief shall be granted. Accordingly, Count IV of the Complaint is hereby DISMISSED. The motion is otherwise denied without prejudice, as the Court, in an exercise of its discretion, declines to exercise supplemental jurisdiction over Plaintiff's state law claims. Plaintiff commenced this action in the Superior Court for the District of Columbia, naming more than a dozen defendants (plus ten John Doe defendants). On June 4, 2012, three defendants-Kaiser Foundation Health Plan of the Mid-Atlantic States, Inc., David Nagle, and Kathleen Logan (collectively, the "Removing Defendants)-filed a #1 Notice of Removal. Therein, the Removing Defendants represent that "[a]ll Defendants consent to the removal of this action in accordance with 28 U.S.C. 1446(b)(2)." However, the use of the defined term "Defendants" here appears to refer solely to the Removing Defendants. Accordingly, by no later than JUNE 15, 2012, the Removing Defendants shall file a memorandum, not to exceed five (5) pages, explaining whether or not they are required to comply with the so-called "rule of unanimity" for removal and, if so, explaining how they have complied with that rule. See, e.g., 28 U.S.C. 1441(c)(2), 1446(b)(2)(A). In particular, if the rule of unanimity applies, the Removing Defendants should explain why the consent of the three District of Columbia defendants, who appeared in the Superior Court without objecting to service, is not required. Similarly, if the rule of unanimity applies, the Removing Defendants should explain why the consent of other defendants who, according to the Superior Court's public docket were served prior to the Notice of Removal, is not required.
