February 26, 2019 Opinion or Order MINUTE ORDER. The Court does not doubt the sincerity of the information provided by the New Jersey counsel for defendant/counterclaimant Stanton Concepts. However, the Court is concerned that two deadlines in this case came and went, and plaintiff/counter-defendant filed a pleading #74 pointing out those omissions, and yet the Court heard nothing from either of the local counsel who have entered appearances on behalf of Stanton in this case until after the Court issued its February 15, 2019 order to show cause. Also, the response to the order to show cause #76 does not inform the Court of plaintiff's position on defendant's request for an order giving it 60 days to locate new lead counsel. Therefore, local counsel must confer with the plaintiff and inform the Court by February 28, 2019 of plaintiff's position on defendant's request. SO ORDERED. Signed by Judge Amy Berman Jackson on 02/26/2019. (lcabj3)

February 15, 2019 Opinion or Order MINUTE ORDER. The scheduling order in this case required the parties to file Markman briefs on January 15, 2019 and replies on February 11, 2019. Defendant/counter-plaintiff Stanton has filed neither. Therefore, it is ORDERED that Stanton must show cause by February 22, 2019 as to why its counter-claim, Dkt. # 10, should not be dismissed for want of prosecution, and why the Court should not adopt Fullyear's proposed claim constructions in their entirety as they appear in Fullyear's Opening Markman Brief. Any additional relief sought by Fullyear must be presented to the Court in a proper motion. SO ORDERED. Signed by Judge Amy Berman Jackson on 02/15/2019. (lcabj3)

July 23, 2018 Filing 69 MEET AND CONFER STATEMENT Joint Case Management Report Pursuant to FRCP 26(f) and Local Rule 16 by FULLYEAR-BROTHER ENTERPRISE CO. LTD.. (Attachments: #1 Proposed Scheduling Order)(Bruce, Joseph) Modified event title on 7/26/2018 (znmw).
May 11, 2018 Opinion or Order MINUTE ORDER. Defendant/counter-plaintiff's motion #57 for leave to file an amended answer, amended counterclaim, and third party complaint is DENIED without prejudice because the motion fails to comport with Local Rule 7 which requires parties to include a statement of specific points of law and authorities in support of their motion. If defendant/counter-plaintiff renews its motion it must explain why it is entitled to relief under the governing case law and Federal Rules of Civil Procedure, in particular Rule 15(a) which concerns amendments to complaints. Moreover, the Court notes that defendant/counter-plaintiff's reliance on Federal Rule of Civil Procedure 14, which it invoked for the first time in its reply brief, seems misguided. See generally 21 Charles Alan Wright & Arthur R. Miller, Federal Practice and Procedure 1442 (3d ed.) ("[I]mpleader is available only against persons who are or may be liable to defendant for part or all of plaintiff's claim; it cannot be used as a way of combining all controversies having a common relationship in one action."). SO ORDERED. Signed by Judge Amy Berman Jackson on 05/11/2018. (lcabj3)

April 17, 2018 Filing 66 Memorandum in opposition to re #57 MOTION for Leave to File PROPOSED AMENDED ANSWER, AMENDED COUNTERCLAIM AND THIRD PARTY COMPLAINT filed by FULLYEAR-BROTHER ENTERPRISE CO. LTD.. (Bruce, Joseph)
April 6, 2018 Opinion or Order MINUTE ORDER. In light of the completion of the USPTO proceedings, the Court will hereby lift the stay in this case. Plaintiff must file its opposition to #57 defendant's motion for leave to file an amended answer, amended counterclaim, and third party complaint by April 17, 2018. Defendant's reply will be due May 1, 2018. The Court notes that current lead counsel for defendant has not filed a motion to withdraw, see Local Civil Rule 83.6, and that pursuant to Local Civil Rule 83.2, any pleadings must be signed by a member of the bar of this Court. So counsel must file the appropriate motion by April 10, 2018, and a member of the bar of this Court must enter an appearance on defendant's behalf by April 13, 2018 so that this matter can proceed. Signed by Judge Amy Berman Jackson on 04/06/2018. (lcabj3)
March 26, 2018 Filing 65 Joint STATUS REPORT REGARDING SECOND REEXAMINATION OF U.S.PATENT NO. 7,931,526 by FULLYEAR-BROTHER ENTERPRISE CO. LTD.. (Patton, George)
January 16, 2018 Opinion or Order MINUTE ORDER. Upon review of the joint status report #64 , the stay will remain in place. Because the USPTO is re-examining the case, the Court finds that it would not be appropriate for the Court to rule on the complex issues in this case while the question of patentability is under active review. The parties must notify the Court within two business days of any decision rendered by the USPTO, and the parties must file a joint status report on April 13, 2018. Signed by Judge Amy Berman Jackson on 01/16/2018. (lcabj3, )
January 12, 2018 Filing 64 STATUS REPORT. (Michel, Christian) Modified event title on 1/16/2018 (znmw).
October 12, 2017 Opinion or Order MINUTE ORDER. Upon review of the Amended Joint Status Report [62, 63] it is ORDERED that the parties must notify the Court within two business days of any decision rendered by the USPTO, and that the parties must file a joint report on January 12, 2018 to update the Court on the status of the reexamination proceeding if no notice has been filed by that time. The Court shares plaintiff's frustration with the age of the case and the length of the stay, and it is aware that the patent has been subject to re-examination before. But it would not be appropriate for the Court to rule on the complex issues in the case while the question of patentability is under active review -- albeit at a snail's pace -- at the USPTO. Therefore, the stay will remain in place. Plaintiff remains free to take defendant up on its offer of a license in the interim, and the parties may notify the Court at any time if they agree that they would benefit from the assistance of a neutral mediator. SO ORDERED. Signed by Judge Amy Berman Jackson on 10/12/2017. (lcabj3)
