Filing 43 ORDER: For the reasons stated in the attached memorandum and order, the Court GRANTS Brooks' motion for summary judgment (Doc. 36 ), and DISMISSES the claim against Brooks without prejudice for failure to exhaust. The claim against Warden Dunc an must also be DISMISSED without prejudice, as that claim was derivative of the claim against Brooks.
