March 11, 2013 Opinion or Order Filing 56 ORDER granting 40 Defendant's Motion for Summary Judgment - Ms. Slinger received three notices of deficiency in a twelve-month period resulting in her termination, consistent with FedEx policy. Her attempt to recast her termination so as t o fit it within the parameters of an Indiana retaliatory discharge case is unsupported by evidence, and therefore unsuccessful. Because Ms. Slinger cannot establish a prima facie case for retaliatory discharge, the Court hereby GRANTS FedEx's Motion for Summary Judgment, [dkt. 40 ].Judgment will enter accordingly.
