Furthermore, the Court will AMEND its January 28, 2013 Entry (Dkt. 79 ) to reflect that the § 1985(3) claim against Mr. Davis and Mr. Klopp is DISMISSED with prejudice. Filing 79 ENTRY - Mr. Martin's Rule 56(d) motion (Dkt. 70 ) is DENIED; Mr. Martin's motion for leave to amend his Complaint (Dkt. 50 ) is DENIED; Mr. Davis's and Mr. Klopp's motion for summary judgment (Dkt. 13 ) is GRANTED for both Mr . Martin's defamation and § 1985 claims; Ms. Puccia's motion to dismiss (Dkt. 25 ) is DENIED in part and GRANTED in part. Specifically, Ms. Puccia's motion to dismiss based on a lack of personal jurisdiction is DENIED; her mot ion to dismiss under Rule 10(b) and her motion for a more definite statement under Rule 12(e) are DENIED; her motion to dismiss the defamation claim is DENIED; and her motion to dismiss Mr. Martin's claim for § 1985(3) conspiracy is GRANT ED. The defamation claim against Defendants Davis and Klopp is therefore DISMISSED with prejudice.
