March 20, 2013 Opinion or Order Filing 35 ENTRY ON DEFENDANTS' MOTIONS TO DISMISS - The motion by the State of Indiana, the Madison County Circuit Court IV-D, and Rodney J. Cummings is GRANTED. The Madison County Sheriff's Department's motion is likewise GRANTED. However, the dismissal of Mr. Jones's claims against the Sheriff's Department is without prejudice. This means that Mr. Jones may amend his complaint to make the necessary factual allegations in support of his alleged incompetency, if the fac ts do indeed support them. If Mr. Jones is aware of detailed facts tending to show his incompetency during the relevant time period, he may be granted leave to amend his complaint to add those facts. Leave shall be granted for this limited purpose only. If Mr. Jones wishes to seek leave to file amended allegations regarding his incompetency, he shall file the appropriate motion by Wednesday, April 10, 2013. If Mr. Jones seeks leave, he shall include with his motion for leave a copy of his proposed amended complaint.1 If no such motion is filed by that date, the Court will enter final judgment dismissing Mr. Jones's claims with prejudice.
