September 30, 2013	Filing 35 ORDER GRANTING DEFENDANT'S PARTIAL MOTION TO DISMISS - For the reasons set forth, we hold that Plaintiffs' complaint is barred. Plaintiffs' various claims--under the Equal Protection Clause of the Fourteenth Amendment of the U.S. Const itution, 42 U.S.C. §§ 2000e, et. seq. ("Title VII"), 42 U.S.C. § 1983, 42 U.S.C. § 1981, and the Indiana Constitution--are barred by res judicata and collateral estoppel, therefore Plaintiffs have failed to state a c laim upon which relief must be granted pursuant to Fed. R. Civ. Pro. 12(b)(6). Accordingly, Defendant's Partial Motion to Dismiss on the basis of is GRANTED, reserving for subsequent resolution Plaintiff Green's claim of retaliation. Filing 35 ORDER GRANTING DEFENDANT'S PARTIAL MOTION TO DISMISS - For the reasons set forth, we hold that Plaintiffs' complaint is barred. Plaintiffs' various claims--under the Equal Protection Clause of the Fourteenth Amendment of the U.S. Const itution, 42 U.S.C. §§ 2000e, et. seq. ("Title VII"), 42 U.S.C. § 1983, 42 U.S.C. § 1981, and the Indiana Constitution--are barred by res judicata and collateral estoppel, therefore Plaintiffs have failed to state a c laim upon which relief must be granted pursuant to Fed. R. Civ. Pro. 12(b)(6). Accordingly, Defendant's Partial Motion to Dismiss on the basis of is GRANTED, reserving for subsequent resolution Plaintiff Green's claim of retaliation.
