Date Filed Document Text
May 2, 2017 Opinion or Order Filing 89 ORDER ON DEFENDANT'S MOTION FOR SUMMARY JUDGMENT - For the foregoing reasons, the Motion for Summary Judgment filed by Defendant Trustees of Indiana University is GRANTED, and Dr. Feresu's Title VII and EPA claims are dismissed (Filing No. 42). The Court previously dismissed Dr. Feresu's two other claims brought pursuant to the Americans with Disabilities Act and Section 1981 based on IU's Eleventh Amendment immunity (Filing No. 20 at 8). Having dismissed all of Dr. Feresu's claims against IU, the Court will issue Final Judgment under separate order. (See Order.) Copy to Plaintiff via U.S. Mail. Signed by Judge Tanya Walton Pratt on 5/2/2017. (JLS)
January 23, 2017 Opinion or Order Filing 87 ORDER ON (1) DEFENDANT'S MOTIONS TO STRIKE AND OBJECTION TO PLAINTIFF'S "SURREPLY FILINGS" AND (2) PLAINTIFF'S REQUEST FOR ADDITIONAL TIME TO RESPOND TO DEFENDANT'S MOTIONS TO STRIKE - IU's Motions to Strike Plai ntiff's Surreply Filings are DENIED (Filing No. 83 ; Filing No. 84 ). As such, Ms. Feresu's Request for Additional Time to respond to Defendant's Motions to Strike Plaintiff's Surreply Filings is DENIED as moot (Filing No. [8 5]; Filing No. 86 ). IU's Motion for Summary Judgment has been more than adequately briefed. The Court does not need additional filings at this point to make a determination regarding the Motion. (See Order.) Copy sent to Plaintiff via U.S. Mail. Signed by Judge Tanya Walton Pratt on 1/23/2017. (JLS) Modified on 1/23/2017 (JLS).
December 13, 2016 Opinion or Order Filing 69 ORDER ON PLAINTIFF'S MOTION TO ALTER OR AMEND JUDGMENT - There was no manifest error in the Court's Entry, and Ms. Feresu failed to point out any facts or law to suggest otherwise. Thus, Ms. Feresu's Motion to reconsider is DENIED ( Filing No. 68 ). The established deadline for Ms. Feresu to file a surreply brief to IU's motion for summary judgment remains in place. Any surreply brief must be filed no later than Monday, December 19, 2016, and must be no more than twenty (20) pages in length. It should not discuss claims that are not before the Court such as claims under the Americans with Disabilities Act and Equal Rights Under Law, 42 U.S.C. § 1981, or for sexual orientation discrimination. Ms. Feresu ack nowledged in her Motion that her duplicative filings at Docket 64 and Docket 65 were filed in error and that the filing at Docket 66 was the "final document." (Filing No. 68 at 1.) Therefore, Filing No. 64 and Filing No. 65 are STRICKEN from the record. (See Entry). Copy to Plaintiff via U.S. Mail. Signed by Judge Tanya Walton Pratt on 12/13/2016.(JLS)
November 17, 2016 Opinion or Order Filing 63 ORDER ON PLAINTIFF'S MOTION FOR EXTENSION TO FILE SURREPLY - The Court GRANTS Ms. Feresu's request to file a surreply and her request for additional time to file the surreply. The surreply should be no more than twenty (20) pages in length and must be filed no later than Monday, December 19, 2016. The parties should expect no further extensions of time. (See order.) Copy to Plaintiff via U.S. Mail. Signed by Judge Tanya Walton Pratt on 11/17/2016. (JLS)
September 3, 2015 Opinion or Order Filing 21 ORDER denying 14 and 15 Ms. Feresu's Motions to Reconsider. Signed by Judge Tanya Walton Pratt on 9/3/2015 (dist made by CRD) (CBU)
