Filing 79 ENTRY DENYING MOTION TO CHANGE VENUE AND LIFTING STAY - In conclusion, while the Southern District of Indiana may be less convenient for the Defendants, they have not met their burden to demonstrate that the Western District of Washington is clea rly the more convenient forum. Instead, based on the arguments presented, the Court concludes that transferring this case would merely and impermissibly shift the inconvenience from the Defendants to CAI. Consequently, Defendants' Motion for Transfer of Venue under 28 U.S.C. §1404(a) (Filing No. 58.) is DENIED. FURTHER, the stay issued on January 13, 2016 (Filing No. 77) is lifted. Parties are to meet and confer regarding new deadlines and contact the Magistrate Judge for approval of a case management plan. (See order for more information). Signed by Judge Tanya Walton Pratt on 5/17/2016. (JLS) |
Filing 56 ENTRY ON MOTIONS TO DISMISS - The Court concludes that it has personal jurisdiction over both Mr. Long and HughGM, and therefore, the Defendants' Motions to Dismiss For Lack of Personal Jurisdiction (Filing No. 27 , Filing No. 30 ) are DENIED. Further, CAI's Motions to File a Sur-Reply (Filing No. 47 ) is GRANTED. Finally, CAI's Motion to Strike (Filing No. 48 ) is GRANTED in part and DENIED in part. Signed by Judge Tanya Walton Pratt on 10/29/2015. (JLS) (JLS). |
