Entry Discussing Request for Monetary Sanctions - This matter is before the Court on Plaintiff's Motion requesting "immediate financial penalty for the intentional destruction of evidence" [dkt. 44]. Plaintiff alleges that he was assau lted by Defendant on December 18, 2014 and that a video recording of the incident existed. The record reflects that no video evidence is currently available depicting the plaintiff's cell or the hallway outside the cell on December 18, 2014. Thus no video can be produced.
