ORDER ON DEFENDANT'S MOTION FOR SUMMARY JUDGMENT - Defendant CSX Transportation, Inc. ("CSXT"), has moved for summary judgment on Plaintiffs', Henry C. ("Kit") and Martha L. Wedemeyer ("Martha") (collectively , the "Wedemeyers"), state law claims. For the reasons stated herein, the Court GRANTS CSXT's motion for summary judgment. Dkt. No. 33. The Court will enter judgment in favor of CSX Transportation, Inc., accordingly. (See Order.) Signed by Judge Larry J. McKinney on 10/20/2015. (RSF)
