August 8, 2006	Filing 5 MEMORANDUM OPINION & ORDER 1) dfts is Brian J. Patton 2) clerk in divisional offc in which the case lies shall prepare and issue summons for Brian J. Patton in his offc. and individual capacities, in additional to summons clerk make 2 sets of copies of summons and mark one to be served on USAtty Gen and one on USAtty for EDKY 3) Clerk also prepare as many copies of complaint as there are summons 4) after clerk has prepared summons forward documents by certified mail to USM at Lexington 5) Clerk enter certified mail receipt into record 6) USM shall serve summons, complaint copy, and copy of this order on dft and shall serve copies of documents on USAtty Gen and USAtty by certified mail 7) USM make return w/in 40 days 8) pla shall keep clerk informed of mailing address, failure may result in dismissal 9) for every further pldg he wishes to submit pla shall serve a copy upon dft or counsel w/certificate of service; if Judge or Mag Judge receives document which has not been filed or which has been filed but fails to include a certificate of service the document will be disregarded by court.
