MEMORANDUM OPINION & ORDER: (1) Defendant/Third-Party Plaintiff AK Steel Corporation's MOTION for Summary Judgment 59 is hereby GRANTED; (2) Plaintiff Eugene Adkins' Complaint DE# 1 is hereby DISMISSED; (3) Defendant/Third- Party Plaintiff AK Steel Corporation's Third-Party Complaint DE# 25 is hereby DISMISSED; and (4)Within ten (10) days from the date of entry of this Order, Third-Party Defendants Relco Locomotives and Relco Finance and Intervenor Plain tiff United Wisconsin Insurance Company shall file a joint and/or individual status reports identifying whether any of the remaining claims need to be adjudicated in view of the dismissal of Plaintiff Adkins' complaint against Defendant AK Steel; alternatively, the parties may submit an Agreed Entry of Dismissal of those claims.
