Filing 50 MEMORANDUM OPINION & ORDER: (1) The IBEW Defendants Motion for Summary Judgment DE#40 is hereby granted; (2) SEIU's Motion to Dismiss DE# 6 is granted in part and denied in part as follows: (a) to the extent SEIU seeks dismissal on 12(b)(1) grounds, its motion is denied, and; (b) to the extent SEIU seeks dismissal on 12(b)(6) grounds, its motion is granted; (3) The Court, in its discretion, declines jurisdiction over Plaintiff's remaining state law claims pu rsuant to 28 USC 1367(c). In Ashland Civil 10-cv-131, Plaintiff's state law claims are hereby dismissed without prejudice as the action was originally filed in this Court. In Ashland Civil 10-cv-83 - originally filed in Boyd Circuit Court and later removed - Plaintiff's remaining state law claims are remanded to Boyd Circuit Court for further proceedings consistent with this opinion; and (4) Both cases shall be stricken from the Court's active docket.
