Filing 8 ORDER: 1. Within 14 days from date of this Order, McFadden must pay $59.03 to the Clerk of Court as an initial partial filing fee. 2. Within 14 days from date of this Order, McFadden shall file a document in the record advising the Clerk of Court of his current mailing address and indicating his intention to continue prosecution of this matter. 3. If McFadden fails to complete both of these required steps within 14 days, the Court will dismiss the Complaint w/o prejudice for failure to prosecute and failure to comply with a Court Order. Filing 6 ORDER: 1. McFadden's Motion for Leave to Proceed in forma pauperis #2 is GRANTED. 2. Within twenty-eight 28 days from the date of this Order, McFadden must pay $59.03 to the Clerk of the Court as an initial partial filing fee. 3. The Clerk of the Court shall open an account in McFadden's name for receipt of the filing fee. The Clerk shall complete a Notice of Payment Form (Form EDKY 525) with (a) McFadden's name, (b) his inmate registration number, and (c) this case number. The Clerk shall serve a copy of this Order and the Notice of Payment Form upon the Jailer/Warden of the institution in which McFadden is currently confined. 4. Each month McFadden's custodial shall send the Clerk pymt in an amt equal to 20% of his income for the preceding month out of this acct, but only if amt. in acct. exceeds $10.00. The custodian shall continue such mthly pymts until the entire $350.00 filing fee is paid. 28 U.S.C. 1915(b)(2). 5. McFadden must immediately advise the Clerk's office of any changes in his current mailing address. Failure to do so may result in dismissal of this case. 6.
