MEMORANDUM OPINION & ORDER: It is ordered as follows: 1) Dfts Fulton, Dames and Weitholder's Motion for Summary judgment 66 is GRANTED IN PART AND DENIED IN PART. Dfts Fulton and Dames' motion for summary judgment on Plf Miller's excessive force and battery claims and Dft Weitholder's motion for summary judgment on Plf Martin's excessive force and bettery claims are hereby DENIED. However, Dfts Fulton, Dames and Weitholder's motion for summary judgment on Plf Gonzalez's deliberate indifference claim is hereby GRANTED; 2) Dfts Bornhorn and Lusardi are granted summary judgment on Plf Gonzalez's deliberate indifference claim pursuant to Federal rjule of Civil Procedure 56(f)(1); 3) TELEPHONE STA TUS CONFERENCE set for 3/20/2013 at 11:00 AM in COVINGTON before Judge David L. Bunning with all remaining parties to schedulue a final pretrial conference and jury trial and to discuss possibility of alternative dispute resolution. Court will i nitiate the call utilizing the counsel's contact information on docket sheet. If counsel prefers to be contacted at a different number, counsel must notify the Court no later than 5:00 p.m. on March 19, 2013. Signed by Judge David L.
