MEMORANDUM ORDER AND OPINION: It is ordered 1) Plaintiffs' motion for leave to amend their Second Amended Complaint 31 is hereby DENIED; 2) Defendant Boone County's Motion to Dismiss 24 is hereby GRANTED; 3) Count Four of Plainiffs' ; Second Amended Complaint is hereby DISMISSED WITH PREJUDICE and 4) The Court declines to exercise supplemental jurisdiction over the pendent state law claims aggainst Boone County, therefore count five of Plaintiff's Second Amended Complaint is hereby DISMISSED WITHOUT PREJUDICE.
