Filing 140 MEMORANDUM OPINION & ORDER: It is ordered 1) Ackermanns motion for reconsideration or, in the alternative, to certify the Courts Order of August 24, 2016, for interlocutory appeal, R. 118, is GRANTED IN PART and DENIED IN PART. Ackermanns motion is GRANTED as to Ackermanns breach-of-contract claims against the City. Ackermanns motion is DENIED as to (1) Ackermanns inverse-condemnation and takings claims and (2) Ackermanns request to certify the Courts prior order, R. 102, for interlocutory app eal; 2) The Courts Order of August 24, 2016, R. 102, is hereby modified and amended to DENY IN PART the Citys motion for summary judgment, R. 69, insofar as it seeks summary judgment on Ackermanns breach-of-contract claims. The City's motion is GRANTED as to Ackermann's breach of contract claims and as to Ackermann's Fi fth Amendment due process claim. In all other respects, the City's motion is DENIED. 2) Ackermann's motion for summary judgment 76 is GRANTED IN PART and DENIED IN PART. Ackermann's motion is GRANTED as to the City's claims against Harbor Greene Residential. In all other respects, Ackermann's motion is DENIED. 3) The City's motion for summary judgment on its breach of contract claims 93 is DENIED. 4) Ackermann's Fifth Amendment takings and state inverse-condemnation claims are DISMISSED WITHOUT PREJUDICE.
