Filing 42 MEMORANDUM OPINION & ORDER: 1) Humana's Motion to Dismiss Plf O'Neal's Counterclaim 25 is granted, and O'Neal's Counterclaim is dismissed with prejudice; 2) Def Perkins's Motion for Summary Judgment 28 is granted, and Judgment is entered in favor of Defendant Perkins; 3) Def O'Neal's Motions for Judgment ( 24 and 33 ) are denied; 5) The clerk shall distribute to Def Tessa Perkins, as executor of Decedent Ted Hamilton' ;s Estate, the funds that Humana deposited into the Court Registry ( 18 and 21 ), plus accrued interest and less the applicable Registry Fees; 6) This matter is stricken from the Court's active docket; and 7) Judgment shall be entered contemporaneously herewith.
