MEMORANDUM OPINION & ORDER: 1. Defendants' Motion to Dismiss or in the Alternative to Compel Arbitration 3 is GRANTED insofar as it seeks to compel arbitration. 2. Yaroma's Complaint is DISMISSED WITHOUT PREJUDICE pending arbitration. 3. Accordingly, all pending motions 29 , 33 are DENIED AS MOOT, and all deadlines are TERMINATED. 4. In light of the explanation provided at the hearing held on September 8, 2015, and given the parties' agreement as to how service was to be executed, the entry of default against Western Sky 26 is VACATED. 5.
