Sims is DENIED; (2)plas' 43 MOTION for Summary Judgment by The Nature Conservancy, Inc.; (3)dfts to restore the sinkhole behind their person al residence, to its condition at the time the property was conveyed to them as detailed in the report of TNC's expert, Gerry Fister; (4)dfts to allow TNC &/or its third-party consultants reasonable access to the property to monitor the removal of the fill material & restoration of the sinkhole; (5)dfts are permanently enjoined from denying TNC reasonable access to the property to conduct annual monitoring & for scientific or educational purposes, as outlined in the Easement; (6)dfts are pe rmanently enjoined from making future topographical alterations to the property which are not authorized by terms of the Easement; (7)dft to pay to pla the reasonable costs & atty fees pla incurred in this action to enforce the terms of the Easement, the amt to be determined by subsequent Order of this Court; (8)That, in order that Court may fix the amt to be paid by dfts to pla as a result of this Order, pla shall submit evidence of its atty's fees & other expenses incurred in this action to enforce the terms of the Easement, as well as the reasonableness thereof, within 20 days of the date of entry of this Order; (9)upon submission of pla's evidence of its atty's fees & expenses as set forth above, pla to state any obj to those amts w/in 10 days; (10)Clerk is directed to submit this matter for review upon conclusion of the briefing schedule outlined above.
