MEMORANDUM OPINION & ORDER: (1) pla's condition of confinement claims asserted against Paul Harvey & Eric Wilson are DISMISSED WITHOUT PREJUDICE; (2) Paul Harvey & Eric Wilson are terminated as dfts; (3) all claims against the remaining 9 FMC L exington dfts in their OFFICIAL CAPACITIES are DISMISSED WITH PREJUDICE; (4) pla's 1st, 5th & 8th Amendment condition of confinement claims alleged to have arisen at FMC Lexington between 2/2008 - 11/2008 against the 9 FMC Lex dfts in their offi cial capacities are DISMISSED WITH PREJUDICE; (5) pla's 1st, 5th & 8th Amendment condition of confinement claims alleged to have arisen at FMC Lexington between 1/15/2009 - 3/2009 consisting of alleged verbal abuse, denied access to telephone & placement in segregation against the 9 FMC Lex dfts in their official capacities are DISMISSED WITH PREJUDICE; (6) pla's remaining condition of confinement claims against the remaining 9 FMC Lex dfts in their individual capacities shall proceed & the clerk shall prepare docs necessary for service of process upon Stephen Dewalt, Michael Growsce, Paul Harvey, Beverly Hoskins, Schmal Jennings, Brian Johnson, Martin Pitt, Allen Terris, Eric Wilson, Nick Alexakos and Scott Anderson; (7) clerk pr epare service packets for each dft; (8) clerk prepare & forward service packets to USM for USA, Atty Gen & BOP; (9) clerk send service packets to USM & make a note in the record; (10) USM shall serve dfts; (11) within 40 days USM shall send a service report to Lex Clerk's Office stating whether service has been accomplished; (12) pla shall immediately advise the Lex Clerk's Office of any change in his address; (13) pla must communicate w/court solely through notices or motions filed w/ Lex clerk's office; court will disregard correspondence sent directly to the Judge's Chambers; (14) all pleadings filed by pla shall be served upon each dft/atty; pla send original to clerk w/certificate of service; if a District Judge or M ag Judge receives any doc which has not been filed w/clerk, it will be disregarded; (15) clerk forward a copy of this order to USDC Northern District of Illinois, Chicago division re Portman v.
