Filing 40 OPINION & ORDER: (1) The Policy at issue does not provide coverage to Dfts Security Safe Outlet, Inc. and/or Matthew Denninghoff for the claims made against them in the underlying litigation, Case No. 5:10-CV-390. (2) Liberty is not obligated or requ ired to defend or indemnify SSO or Denninghoff with respect to the claims made against them in the underlying litigation. (3) Liberty has no other obligation or duty to either Budsgunshop.com, Marion E. Wells, Jr., Rex McClanahan or any other party, arising out of the claims made in the underlying litigation. (4) Liberty's 37 MOTION for Summary Judgment is GRANTED. (5) Liberty's request for oral argument is DENIED. (6) All matters have been resolved in this case, judgment in favor of Pla shall be entered contemporaneously with this Opinion & Order pursuant to FRCP 58.
