Filing 28 OPINION & ORDER: (1) Faul's 20 MOTION to Amend Complaint is GRANTED and the Clerk is DIRECTED to FILE Faul's tendered amended complaint. (2) This action REMAINS PENDING only against the BOE for the claims asserted in the Amended Compla int; all claims against Carmen Coleman, individually and in her capacity as Superintendent of Danville Independent School District, are DISMISSED WITH PREJUDICE. (3) Pursuant to 28 USC 1367(c)(3), this Court declines to exercise jurisdiction over the remaining state law claims and therefore this matter is REMANDED to Boyle Circuit Court. (4) Clerk shall send a copy of this Opinion and Order to the Clerk of the Boyle Circuit Court. (5) Faul's 21 MOTION to Remand to State Court is DENIED AS MOOT.
