OPINION & ORDER: 1) Pla's Motion for Contempt Order and Sanctions against Dft Tracy Grounds for Failure to Appear at Deposition (DE 92 ) is GRANTED in part and DENIED in part. The motion is GRANTED to extent that Pla reques ts sanctions be imposed on Tracy Grounds for failure to appear at her deposition and motion is otherwise DENIED; 2) Tracy Grounds SHALL pay reasonable attorney's fees charged by Plas' counsel for preparing for deposition and c osts of retaining court reporter and videographer; 3) Within 10 days of entry date of this Opinion and Order, Plas' counsel shall file in record evidence of costs and fees described above; 4) Dft Tracy Grounds may file response to Plas' sub mission of evidence. However, any such response MUST be filed within 5 days of Dft's receipt of Plas' submission; 5) Plas' Motion to Compel (DE 74 ) and motion by various Dfts for extension of time to respond to it (DE 90 ) a re DENIED as moot, Court having established at recent status conference a schedule for responding to pending discovery requests; and 6) Mark Jensen is DISMISSED as dft in this matter, Court having by prior opinions dismissed all claims against him.
