Filing 5 MEMORANDUM OPINION & ORDER: (1) Gross' motion to proceed in forma pauperis 3 , is OVERRULED and DENIED. (2) Gross must pay $350 filing fee to Clerk w/in 20 days. (3) If Gross fails to pay full filing fee w/in specified time, Court will dismiss case for failure to prosecute, but will enter separate Order: (a) assessing entire $350 filing fee and (b) directing Gross' custodian to remit payment from inmate account. (4) case will not be reinstated even if Gross sub sequently pays filing fee. (5) Court may bar future filings by Gross unless accompanied by full amount of filing fee.
