Filing 46 MEMORANDUM OPINION & ORDER: (1) Dfts motion for summary judgment, R. 34 , is GRANTED IN PART AND DENIED IN PART. (a) Arch is entitled to summary judgment on the Sergents negligence per se claim. (b) The Sergents negligence and spousal c onsortium claims may proceed to trial, but they may not recover emotional damages. (c) International Coal Group, Inc., and ICG, Inc. of Delaware, are both entitled to summary judgment and are DISMISSED from this case. (2) A telephone confer ence is SCHEDULED for Friday, December 13, 2013, at 11:00 a.m., to discuss the scheduling of trial. A court reporter is needed and will be provided by the Court.
