King's Motion to Dismiss Plaintiff's Complaint for Failure to State a Claim Upon Which Relief Can Be Granted And To Decline Supplemental Jurisdicti on of State Claims 7 is DENIED as moot. IT IS FURTHER ORDERED that Defendants Gregory R. Horton and Sarah A. King's Motion to Dismiss Plaintiff's Amended Complaint for Failure to State a Claim Upon Which Relief Can Be Granted And To Dec line Supplemental Jurisdiction of State Claims 13 is GRANTED, in part, and DENIED, in part. The Court DISMISSES Counts II and IV for failure to state a claim pursuant to Fed.R.Civ.P. 12(b)(6).
