October 15, 2015	Filing 32 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Plaintiff Surgical Instrument Manufacturers, Inc.'s Motion for Summary Judgment (ECF No. 20) is GRANTED in part. IT IS FURTHER ORDERED that judgment be entered in favor of Plaintiff Surgical Instr ument Manufacturers, Inc. and against Defendant Atlas Spine, Inc. on Count I of Plaintiff's Complaint in the amount of $190, 848.83 as principal, plus $54,618.02 in prejudgment interest accrued through October 15, 2015, plus post-jud gment interest at the contractual rate of 18% per annum. IT IS FURTHER ORDERED that Counts II and III of Plaintiff's Complaint are DISMISSED without prejudice. IT IS FURTHER ORDERED that Plaintiff Surgical Instrument Manufacturers, Inc. sh all submit supplemental briefing regarding the amount of attorney's fees and costs to be awarded no later than November 5, 2015, and Atlas Spine, Inc. shall file any responsive pleading thereto no later than November 19, 2015.
