ORDER: IT IS HEREBY ORDERED that Plaintiffs' "Voluntary Partial Dismissal" (Doc. No. 106 ), purportedly dismissing with prejudice their negligence claims, and dismissing with prejudice Allied Services, LLC, as a Defendant, is construed as a motion for leave to dismiss with prejudice the negligence claims and Allied Services, LLC, and is GRANTED. IT IS FURTHER ORDERED that Plaintiff's motion for leave to file an amended complaint (Doc. No. 72 ), which effectively dismisses the claims and party noted above, is GRANTED. The Clerk's Office shall docket Docket No. 80 as Plaintiffs' First Amended Complaint. Pursuant to the Court's Order dated June 6, 2016, Defendants shall have ten days from the date of this Order to file replies addressing the two pending motions for summary judgment. ORDER: IT IS HEREBY ORDERED that this Court's Order (Doc. No. 21) dated October 17, 2014, consolidating for pretrial purposes numerous individual cases with this putative class action, and designating this case as the Lead Case, is VACATED. IT IS FUTHER ORDERED that all the individual cases listed in the October 17, 2014 Order, as well as in the Courts two subsequent orders of consolidation (Doc. Nos. 24 and 29), shall be CONSOLIDATED for pretrial purposes with John Henschke v. Republic Services, Inc., No. 4:14-CV-01570 (the lowest numbered individual case), which shall be designated as the Lead Case. The undersigned will preside over all pretrial motions in these consolidated cases, including ruling on any dispositive and Daubert motions. IT IS FURTHER ORDERED that all future filings in the consolidated individual cases, other than pleadings as defined in Rule 7(a) of the Federal Rules of Civil Procedure, should be made in Case No. 4:14-CV-01570 and should only reference that case number. Pleadings as defined in Rule 7(a) should be filed only in the individual (original) case file. IT IS FURTHER ORDERED that the parties in the consolidated individual cases, and the class action case, shall coordinate discovery to the extent possible. Discovery taken in the class action case (4:14CV01421AGF) and in the consolidated individual cases (4:14CV1570AGF) shall be available for use in both cases, subject to the Court's ruling on more specific objections. IT IS FURTHER ORDERED that the motion (Doc. No. 43) to consolidate Bailey v. Republic Services, Inc., No. 4:15-CV-00403-JAR, with the previously consolidated class action and individual cases is DENIED as moot, in light of the above Order vacating the consolidation of the class action case and the individual cases, but may be refiled as appropriate.
