MEMORANDUM AND ORDER -.....IT IS HEREBY ORDERED that defendants David Killion and Michael Killions motion to dismiss is GRANTED. [Doc. 9] The Court dismisses with prejudice Count I and II of plaintiffs Complaint. The Court declines to exerc ise supplemental jurisdiction over the remaining state law fraud claim, and dismisses Count III without prejudice.
