September 21, 2015 Opinion or Order Filing 12 MEMORANDUM AND ORDER : IT IS HEREBY ORDERED that defendants' partial motion to dismiss [Doc. # 7 ] is granted as to the claim against defendant City of Cottleville in Count I and as to all claims asserted in Count II. IT IS FURTHER ORDERED th at defendants motion to dismiss Count III is denied without prejudice. IT IS FURTHER ORDERED that plaintiff shall have 30 days in which to file a motion for leave to amend his complaint with respect to the claim asserted in Count III. A copy of th e proposed amended complaint must be attached to the motion as an exhibit.
