MEMORANDUM-DECISION and ORDERED, that Defendant Gannons Motion to dismiss (Dkt. No. 8) is granted and all claims against him are dismissed with prejudice; and it is further ORDERED, that Defendants Gizzi and Gizzi, Jr.s Motion to dismiss (Dkt. No. 5) is GRANTED in part and DENIED in part; and it is further ORDERED, that Plaintiffs Motion to amend his Complaint (Dkt. No. 18) is GRANTED; and it is further ORDERED, that if Plaintiff wishes to proceed with this action against Defendant Tri-Valley, he must file an amended complaint as directed above within thirty (30) days from the date of filing of this Decision and Order.
