DECISION AND ORDER granting # 4 Defendant's motion for an Order directing him to deposit Plaintiff's down payment into Court pursuant to Fed.R.Civ.P. 67(a); that Defendant's motion for an Order directing Plaintiff to pay for his costs and reasonable attorneys' fees (Dkt. No. 4 ) is denied. Within FOURTEEN (14) DAYS of the filing date of this Decision and Order, Defendant shall deposit with the Clerk of the Court (along with a copy of this Decision and Order) a certified ch eck or cashier's check (drawn on a bank insured by the FDIC or FSLIC) in the amount of ONE HUNDRED NINETY-NINE THOUSAND FIVE HUNDRED DOLLARS ($199,500), representing Plaintiff's down payment made pursuant to the Contract between the pa rties, with any interest having accrued thereon; and within FOURTEEN (14) DAYS of the Clerk of the Court's receipt of the above-referenced amount, the Clerk of the Court shall take all reasonable steps to place the above-specified funds in some form of interest-bearing account using the Court Registry Investment System. Upon the deposit of Plaintiff's down payment with the Clerk of the Court, Defendant shall be DISCHARGED from liability with regard to Plaintiff's claims, and the Clerk of the Court shall memorialize Defendant's DISMISSAL from this action through a separate entry on the action's docket sheet.
