Filing 189 DECISION AND ORDER granting # 163 Defendant Tarolli's Motion for Summary Judgment; granting # 166 Woodbind Defendants' Motion for Summary Judgment; and denying # 165 Plaintiff's Motion for Summary Judgment. The following claims ar e DISMISSED with prejudice: (1) Plaintiff's First Claim under 42 U.S.C. § 9607(a) against Defendant Tarolli; (2) Plaintiff's First Claim under 42 U.S.C. § 9607(a) against Defendant Collingswood; (3) Plaintiff's First Claim un der 42 U.S.C. § 9607(a) against Defendant Harrison; (4) Plaintiff's First Claim under 42 U.S.C. § 9607(a) against Defendant Woodbine; (5) Plaintiff's First Claim under 42 U.S.C. § 9607(a) against Defendant Swanson;(6) Plainti ff's Second Claim for contribution under 42 U.S.C. § 9613(f). The following claims are DISMISSED without prejudice to refiling in New York State Court within THIRTY (30) DAYS of this Decision and Order pursuant to 28 U.S.C.§ 1367(d): (1) Plaintiff's Third Claim for state law breach of duty; (2) Plaintiff's Fourth Claim for state law negligent representation; (3) Paintiff's Fifth Claim for state law interference with use and enjoyment of property; (4) Plaintiff's Sixth Claim for state law breach of contract. The following claims and cross-claims remain pending: (1) Plaintiff's First, Second, Third, Fourth, and Fifth Claims as against the Woodbine Defendants; (2) Plaintiff's Sixth Claim as against Woodbine Business Park and Swanson; (3) Plaintiff's First Second, Third, Fourth, and Fifth Claims as against Tarolli; (4) Plaintiff's First, Second, Third, Fourth, and Fifth Claims as against National Grid (US) Holdings; (5) Defendants' cross-claims for inde mnification and contribution asserted by, and/or against Tarolli, the Woodbine Defendants, and National Grid (US) Holdings; and (6) Woodbine Defendants' counter-claims against Plaintiff. This case is referred back to Magistrate Judge Peebles to determine the status of discovery and to set expedited pretrial deadlines, if necessary, given the age of this case.
