May 27, 2015	Filing 9 DECISION AND ORDER: It is ORDERED that the Plaintiff's claim pursuant to 42 U.S.C. § 1983 is DISMISSED with leave to amend; Supplemental jurisdiction is DECLINED over plaintiff's state law defamation claim, without prejudice and subje ct to reconsideration by the undersigned in the event plaintiff submits a second amended complaint that states a claim under § 1983. If plaintiff wishes to file a second amended complaint curing the deficiencies identified in the Report-Recomme ndation, he must do so within thirty days of the date ofthis Decision and Order. Plaintiff is reminded that any second amended complaint will replace his prior complaint in its entirety. In the event plaintiff fails to file a second amended complain t within the time allotted, this case will be closed and judgment entered accordingly without further order; and that the Clerk serve a copy of this Decision and Order upon plaintiff in accordance with the Local Rules.
