No. 7) is APPROVED and ADOPTED in its entirety; and it is further ORDERED, that Plaintiffs claim for retaliation in violation of 29 U.S.C. § 794(a)(2) against Defendants Tyson Krieger, John Johnson, Alane Varga, Steve Pattarini, Judith Kirkpatrick,Todd Hutton, and Lawrence Gilroy is DISMISSED without leave to amend; and it is further ORDERED, that Plaintif fs claims for intentional and negligent infliction of emotional distress against all Defendants are DISMISSED with leave to amend. If Plaintiff wishes to proceed with his claims for intentional and negligent infliction of emotional distress, he may d o so by filing, within thirty (30) days of the filing date of this Order, an amended complaint thatremedies the deficiencies identified in the Report-Recommendation; and it is further ORDERED, that the Clerk of the Court issue a summons and forward i t, along with copies of the Complaint (Dkt. No. 1), the Report-Recommendation (Dkt. No. 7), this Order, and a packet containing General Order 25, to the United States Marshal for service upon Defendant Utica College; and it is further ORDERED, that D efendant Utica College file a response to Plaintiffs Claims I-III as provided for in the Federal Rules of Civil Procedure; and it is further ORDERED, that any paper sent by a party to the Court or the Clerk shall be accompanied by a certificate setting forth the date a true and correct copy of it was mailed to all opposing parties or their counsel.
