Filing 35 OPINION & ORDER re: 28 FIRST MOTION to Dismiss the Second Amended Complaint. filed by Paul T Sweeney. For the reasons described herein, Defendant's motion to dismiss the Second Amended Complaint is GRANTED IN PART and DENIED IN P ART. (ECF No. [X].) Defendant's motion to dismiss the causes of fraudulent inducement by misrepresentation or omission of investments (f) through (m), based on statements made in the August 2007 Universal Music contract document and in conver sations about the Universal music contract occurring shortly after June 2007, is DENIED WITHOUT PREJUDICE. All other claims are DISMISSED. The Court also schedules a status conference for August 10, 2015 at 3:30 p.m. Counsel for the parties should report to Courtroom 1306 at the Thurgood Marshall U.S. Courthouse, 40 Foley Square, New York, NY 10007.
