For the foregoing reasons, Defendants' motion to dismis s is GRANTED in part and DENIED in part. The Court dismisses Plaintiff's claims for gender discrimination under Title VII, the NYSHRL, and 42 U.S.C. § 1983. The remaining claims are Plaintiff's claim for retaliation and disability disc rimination under Title VII, the NYSHRL, 42 U.S.C. § 1983, and the ADA. The Court respectfully directs the Clerk to terminate the motion at ECF No. 28. Defendants are directed to file an answer within 30 days of the date of this Order. The partie s are directed to appear for an in-person initial pretrial conference on September 14, 2016, at 12:00pm.
