Filing 42 OPINION AND ORDER re: 28 MOTION to Dismiss for Failure to State a Claim filed by George V. Krom, Jr., Adrian H. Anderson, Kirk A. Imperati.The motion to dismiss is GRANTED. By November 10, 2018, plaintiff shall file a second amended c omplaint. The Clerk is instructed to terminate the motion. (Doc. #28). The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied f or the purpose of an appeal.
