Filing 36 MEMORANDUM OPINION AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE L. PATRICK AULD signed on 10/15/2014 RECOMMENDING that Plaintiffs' Motion to Remand (Docket Entry 18 ) be denied. FURTHER RECOMMENDING that Defendants' Motions to Dismiss (Docket Entries 10 , 15 , 26 ) be granted in part in that Plaintiffs' claims under 42 U.S.C. § 1983 for violations of procedural due process and of equal protection under the United States Constitution be dismissed. FURTHER RECOMMENDING that, as to any state-law claims, this action be remanded to the General Court of Justice, Superior Court Division, Forsyth County, North Carolina pursuant to 28 U.S.C. § 1367(c)(3).
