Filing 23 MEMORANDUM OPINION AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE signed by MAG/JUDGE JOE L. WEBSTER on 08/05/2015; the Court RECOMMNEDS that Defendant's Motion to Dismiss Improper Parties (Docket Entry 6 ) be GRANTED an d that Plaintiff's "Motion to Amend Improper Party" be DENIED (Docket Entry 19 ). The Court RECOMMENDS further that the record be amended to reflect the Commissioner as the only defendant in this action. Additional ly, after a careful consideration of the evidence of record, the Court finds that the Commissioner's decision is not supported by substantial evidence. Accordingly, this Court RECOMMENDS that the Commissioner's decision finding no disability be REVERSED, and the matter be REMANDED to the Commissioner under sentence four of42 U.S.C. § 405(g). The Commissioner should be directed to remand the matter to the ALJ for further administrative action as set out above. To this extent, Plaintiff's Motion for Judgment on the Pleadings (Docket Entry 17 ) should be GRANTED and Defendant's Motion for Judgment on the Pleadings (Docket Entry 21 ) be DENIED. To the extent that Plaintiff's Motion seeks an immediate award of benefits, it should also be DENIED. (Garland, Leah) |
