It is ORDERED that the defendant IHFC Properties, LLC's motion for summary judgment, (Doc. 99 ), is GRANTED in part and DENIED in part as follows: IHF C's motion for summary judgment is GRANTED as to all claims against it by the plaintiff, Jiangmen Kinwai Furniture Decoration Co. Ltd, and all of the plaintiff's claims against IHFC will be dismissed with prejudice in a judgment to b e entered when appropriate; It is established for purposes of the trial on IHFC's counterclaims that there was a valid contract between IHFC and Kinwai and that IHFC did not breach the contract when it relocated Kinwai; IHFC's motion for summary judgment is GRANTED as to the plaintiff's seventh defense to IHFC's counterclaims. Except as stated herein, IHFC's motion for summary judgment on its counterclaims is DENIED. (Coyne, Michelle)

Ltd, and the plaintiffs counsel, Venus Springs, have violated Federal Rule of Civil Proc edure 11(b)(2), that this finding is a sufficient deterrent, and that no sanction is appropriate as to Kinwai given its lack of responsibility for the argument or as to Ms. Springs given the limited nature of the specific violation before the Court and the possibility that incompetence, rather than bad faith, was behind the specific violation. MEMORANDUM OPINION and ORDER signed by JUDGE CATHERINE C. EAGLES on 8/31/2015. For these reasons and the reasons stated in open court on August 6, 2015, it is ORDERED that Kinwai's motion to lift stay and vacate protective order, (Doc. 83 ), is DENIED. It is further ORDERED that the motion for protective order and to quash subpoenas filed by IHFC and the subpoenaed entities, (Doc. 85 ), is GRANTED. IHFC and the subpoenaed entities are entitled to recover reasonable expenses, which the Court will consider pursuant to the schedule established in open court on August 6, 2015. (Butler, Carol)
